The Partnership for Educational Choice, a collaboration between the Institute for Justice (IJ) and EdChoice, has announced its plan to intervene in a legal case concerning Wyoming's Education Savings Account (ESA) program. The lawsuit was filed by the Wyoming Education Association (WEA), challenging the constitutionality of the state's expanded ESA program.
In March, Governor Mark Gordon of Wyoming signed into law the Steamboat Legacy Scholarship Act, which broadened the scope of the state's previously small ESA program that had been established by legislation last year.
Thomas M. Fisher, Executive Vice President and Director of Litigation at EdChoice Legal Advocates, stated, "Parents in Wyoming deserve the freedom to choose the best educational options for their children, especially when the public system doesn’t meet every child’s needs." He added that they would be working quickly with partners at IJ to defend family rights across Wyoming.
The Partnership for Educational Choice was initiated in late 2023 as a project by IJ and EdChoice. For over thirty years, IJ has been at the forefront of defending educational choice programs and enhancing access to education. Since its inception in 1991, it has represented parents in numerous educational choice lawsuits across various courts including four cases at the U.S. Supreme Court: Zelman v. Simmons-Harris, Arizona Christian School Tuition Organization v. Winn, Espinoza v. Montana Department of Revenue, and Carson v. Makin.
EdChoice has played a key role in providing essential research and information on educational choice expansion nationwide. In late 2023, it introduced EdChoice Legal Advocates to support litigation efforts.
As a nonprofit organization under section 501(c)(3), EdChoice is dedicated to promoting educational freedom and choice as pathways to successful lives and stronger societies. It aims to empower families by enabling them to select suitable learning environments for their children’s needs.
