A lawsuit has been filed against the Trump-Vance administration by a coalition of school districts, parents, AFT affiliates, and nonprofit organizations. The legal action is in response to the alleged unlawful withholding of over $5 billion in education funding intended for the 2025-26 school year. The funds were meant to support schools nationwide, especially those in under-resourced communities.
A motion seeking immediate relief through a preliminary injunction is expected later this week.
Randi Weingarten, President of the American Federation of Teachers (AFT), stated that educators are facing significant financial uncertainty due to these developments. "Millions of educators who have been busy planning for the new school year have instead had a monkey wrench thrown at them," she said. She emphasized that the funds were designated for essential programs such as summer school and migrant education.
Weingarten praised the affiliates involved in filing the lawsuit for their efforts to highlight the impact on students and educators. She accused the Trump administration of undermining public education and acting beyond its legal authority. "Since day one, the Trump administration has attacked public education," Weingarten noted.
The plaintiffs, represented by Democracy Forward, argue that these actions breach several laws including the Administrative Procedure Act and constitutional principles. The coalition includes multiple educational organizations from various states across America.
