New York proposes first statewide policy for dual enrollment opportunities

The New York State Education Department has introduced proposed regulations to create a statewide policy for dual enrollment programs. These programs enable high school students to earn college credit while completing their graduation requirements, which research shows can improve outcomes such as high school graduation rates and college degree completion.

Although New York has the third-largest dual enrollment population in the United States, there has not been a unified framework to ensure consistent quality and accountability across the state. The new proposal aims to address this gap by establishing standards designed to benefit all students, with a focus on those who have historically lacked access.

Chancellor Lester W. Young, Jr. stated, “This proposal builds upon the Board’s unwavering commitment to equity and excellence. With these regulations, we are rewriting the playbook to make sure dual enrollment is rigorous and informed by data. This is about building stronger partnerships and creating pathways to opportunity that will shape lives for generations to come.”

Commissioner Betty A. Rosa added, “These proposed regulations are equity in action. By setting clear statewide standards for dual enrollment programs and strengthening partnerships between P-12 schools and colleges, we are leveling the playing field. In these programs, students have the chance to earn college credit, build confidence, and step into their future prepared to succeed in college, careers, and beyond.”

Key aspects of the proposed regulations include requiring school districts, charter schools, and Boards of Cooperative Educational Services (BOCES) with dual enrollment programs to submit partnership agreements with participating colleges or universities by September 1, 2026. These agreements must outline program details and be updated at least every five years.

In addition, both P-12 partners and higher education institutions would need to report participation and outcome data annually. This information will be published on the Department’s website each year for transparency.

Dual enrollment courses must also meet specific standards: they must be credit-bearing; included in partner institutions’ course catalogs; and maintain comparable learning outcomes, content, and rigor as other sections of those courses regardless of how or where they are delivered.

A Notice of Proposed Rule Making is scheduled for publication in the State Register on September 24, 2025. This will begin a 60-day public comment period during which stakeholders can provide feedback on the proposed changes.
