Rhode Island officials guide schools on LGBTQ+ rights amid federal policy changes

Attorney General Peter F. Neronha and Rhode Island Department of Education Commissioner Angélica Infante-Green have issued guidance to schools on maintaining the rights of LGBTQ+ students and continuing diversity programs. This guidance comes amid questions raised by recent executive actions regarding support for LGBTQ+ students and the continuation of diversity, equity, inclusion, and accessibility initiatives.

The guidance advises that Rhode Island schools should not alter current practices related to these areas until the legal implications of the executive actions are resolved. Attorney General Neronha emphasized, "As the new Administration continues to prioritize chaos, confusion, and fear over the American people, it is important for responsible leaders at every level of government to provide clarity to their constituents whenever possible."

Commissioner Infante-Green highlighted educators' responsibilities: "Educators have a moral and legal duty to ensure all students can learn and thrive in school environments that support and empower them to achieve their highest potential."

The Trump Administration's Executive Order on gender identity has directed federal agencies to review grants related to sex-based rights but does not compel state or local officials to act. The order has faced opposition based on Supreme Court precedent and recent court decisions.

Neronha said that local education agencies should not respond to this Executive Order unless its validity is confirmed by courts or Congress. Additionally, Rhode Island regulations protecting LGBTQ+ students remain in effect.

The Trump Administration's efforts to curtail diversity initiatives through executive orders have also been challenged legally. Courts have blocked attempts to withhold funding from organizations with such programs. Diversity policies in Rhode Island align with state and federal law, ensuring continued promotion of inclusivity goals.
